PyxTunes™ WorldSong Contest Rules, Terms & Conditions
1.ELIGIBILITY:
PyxTunes™ WorldSong Contest (the "Contest") is open to anyone, anywhere who is at least eighteen (18) years old at the time of entry. If entrant is under 18 years of age, the signature of a parent or guardian is required. All applicable federal, state and local laws and regulations apply. Void where prohibited or restricted.
2. CONTEST SUBMISSION:
Video Submission Phase: Participant must be a sole musician or member of a band to enter a submission. Participant must be a member of the PxyTunes Global Music site. Go to http://www.pyxtunes.com and login or to create a PyxTunes Musician Account. Creating an account is free. Follow the links and instructions to submit a music video featuring your band's original music (the "Submission").
Submission Requirements:
Submission must contain a complete original song.
Participant must own all copyright and performance rights to music and video submission.
Participants must have a Pyxix Musician Account.
Submission must comply with the Pyxtunes Terms of Service located at http://www.pyxtunes.com/terms.php
Submission must not exceed 10 minutes in length.
Submission must not exceed 100 MB in size.
Participant must leave the Submission on site the entire contest period through November 31, 2008 to be eligible.
These are the Official Contest Rules. During the registration process, each participant will be required to confirm that they agree to be bound by these Official Rules. Loss of eligibility will occur when any Submission includes content that is deemed inappropriate, indecent, obscene or otherwise does not comply with the Pyxtunes Terms of Use as determined by Pyxix™, the sponsor. Pyxix™, (the “Sponsor”), is not responsible for lost, late, incomplete, invalid, unintelligible, or misdirected entries. In addition, by entering, contestants represent and warrant that their Submissions are their own original creations, do not infringe any other person's or entity's rights, and that they have received permission from anyone featured in the Submission to enter this Contest.
Pyxix retains the rights to change/update the Official Contest Rules at anytime.
2. CONTEST PERIOD:
The Updated Contest begins on Sept 15th 2008 and the last day for Submissions is 11:59 p.m. PT on November 14, 2008 (the "Contest Entry Period")
3. PRIZES: Monthly $250 prize for music in ANY of the following categories:
1. Electronica
2. Rap / Hip Hop
3. Rock / Indie / Pop
4. Punk / Metal
5. World / World Fusion
6. Blues / Soul / Reggae
7. Folk / Country / Bluegrass
8. Desi (Indian)
9. Classical / Jazz
10. Catch-All
11. Music video
4. GENERAL RULES:
By entering a Submission, participant agrees to be bound by these Official Rules. Pyxix™ is not responsible if the Contest must be stopped or postponed due to infection by virus, bugs, worms, tampering, unauthorized intervention, fraud, technical failures, or any other causes which, in the sole opinion of the Pyxix™, may corrupt or affect proper conduct of this Contest. Pyxix™ reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the Contest, and select the winner for the Contest, from the entries received prior to the termination of the Contest Entry Period. Pyxix™ assumes no responsibility for electronic hardware, programming or software malfunctions, or failures, or line connections, accessibility or availability, or technical failures of any kind, or unauthorized human intervention, or the incorrect or inaccurate capture of any Submission or other information, or for the failure to capture any such information. Pyxix™ is not responsible for: (1) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (2) any incorrect or inaccurate information, whether caused by participants, or by any of the equipment or programming associated with or utilized in the Contest; (3) technical or human error which may occur in the administration of the Contest or the processing of entries; or (4) unauthorized human intervention in any part of the Submission process or the Contest.
By participating in this Contest, participant hereby waives, releases, and agrees to hold harmless, Pyxix™, and its affiliates and their respective parents, subsidiaries, affiliates, distributors, advertisers and all of their directors, employees, representatives and agents, from and against, any and all rights, claims and causes of action that they may have, or which may arise, against any of them for any liability for any matter, including but not limited to any injury, loss, or damage, whether compensatory, incidental or consequential, to a person or property, arising in whole or in part, directly or indirectly, from his/her participation in this Contest, or any related Contest sponsored by Pyxix and/or its Affiliates, or by his/her acceptance, possession, use or misuse of the prize awarded in the Contest..
Winner agrees that any and all disputes, claims and causes of action arising from or relating to this Contest or any prize awarded in this Contest shall be resolved under the laws of California without respect to any conflict of law issues, and participant agrees that such shall be resolved individually, without resort to any form of class action, and exclusively by the Federal and State Courts of Los Angeles, CA.
5. WINNING SUBMISSIONS:
Contest winners grant Pyxix the right to broadcast the winning submissions on Pytunes™ and its other sites for a period of no less than one year from winning date. After that date songs may be taken off sites with written notification by winner. Winners may be offered additional optional promotion/distribution offers from Pyxix™ which, if selected, may supercede any/all agreements here.
